Avery Methinks social acceptance will never happen. Most men will never accept any law which interferes with their ability to have sex with women . Any not many women will either. And the justice system isn't big enough to accommodate all the new criminals.
State laws could become less important than company policy.
If a company decides that fitness is A GOOD THING it can attempt to mandate the wearing of activity trackers. If a company decides that over-population is A BAD THING it could, conceivably (lol) adjust these to also track sexual activity. Then it becomes a matter of: If you can measure it, you can manage it.
Social acceptance could become a straight choice between having a job, car, house and entertainment or trying to exist on welfare... which (run by private companies) could also require applicants to wear activity monitors.
Dystopia is always just around the corner I'm afraid. It's up to every generation to maintain its hard won rights and freedoms.
